Our client is seeking a highly experienced and diligent Senior Legal Counsel specializing in Data Privacy to join their entirely remote legal team. This position is integral to ensuring the company's compliance with global data protection regulations and mitigating privacy-related risks. You will be responsible for advising on privacy policies, data processing agreements, incident response, and cross-border data transfers. The ideal candidate possesses a Juris Doctor degree, admission to a state bar, and extensive experience advising on privacy laws such as GDPR, CCPA, and others. This role demands exceptional analytical skills, a thorough understanding of legal principles related to data privacy, and the ability to provide practical, business-oriented legal counsel in a dynamic environment. Responsibilities: Provide expert legal advice on a wide range of data privacy and data protection matters, including compliance with GDPR, CCPA, and other applicable laws and regulations. Draft, review, and negotiate data processing agreements (DPAs), Data Sharing Agreements, and other privacy-related contracts. Develop, implement, and maintain the company's global privacy policies, procedures, and training programs. Advise on privacy considerations for new product development, marketing initiatives, and technology deployments. Manage and respond to data subject access requests (DSARs) and other individual rights. Lead the company's response to data breaches and privacy incidents, including coordinating with regulatory authorities. Conduct privacy impact assessments (PIAs) and data protection impact assessments (DPIAs). Monitor changes in privacy laws and regulations globally and advise on their impact on the business. Collaborate with internal stakeholders, including IT, security, marketing, and product teams, to ensure privacy compliance. Represent the company in interactions with regulatory bodies and external counsel. Stay abreast of emerging trends and best practices in data privacy and cybersecurity. Qualifications: Juris Doctor (JD) degree from an accredited law school. Admission to practice law in at least one U.S. state and in good standing. Minimum of 7 years of experience in data privacy law, either in-house or at a law firm. Deep understanding of major privacy regulations (e.g., GDPR, CCPA/CPRA, HIPAA, PIPEDA). Experience with international data transfer mechanisms (e.g., SCCs, BCRs). Certified Information Privacy Professional (CIPP/US, CIPP/E) or equivalent certification is highly preferred. Exceptional analytical, research, and problem-solving skills. Excellent written and verbal communication skills, with the ability to clearly articulate complex legal issues. Proven ability to manage multiple projects simultaneously and work independently in a remote setting. Strong negotiation and drafting skills. Experience advising technology or SaaS companies is a significant plus.
